Disclaimers and Hold Harmless Agreement

CAUTION: This Program is NOT a replacement for the aircraft manufacturer’s manual. You are responsible for being familiar with the manufacturer’s manual for any aircraft, including all equipment and appurtenances related to such aircraft. Read all information before proceeding with installation, maintenance or repair. Use specified materials and follow instructions in the order given to avoid damage to or shorter than expected service life of any aircraft or any aircraft parts or equipment. Check applicable Aircraft Manual for specific instructions that may supersede or be required in addition to the procedures in this Program, and contact the aircraft manufacturer for information on special situations not covered by this Program.   

 

CAUTION: The Program is only intended for the use of the person purchasing this product and in no event shall it be transferred to or provided in whole or in part to any other individual or entity.  

 

 

 

HOLD HARMLESS AGREEMENT: By purchasing this [training program product] (the “Program”), you agree to hold harmless Shiny Jets, LLC and its subsidiaries and affiliates (“Seller”) from any claims, expenses, damages, losses, or any other cause of action with respect to your acts or omissions in the performance of maintenance, repair or modification of any aircraft or aircraft equipment, including but not  limited to, damage to the aircraft interior, exterior, paint, avionics, electrical or mechanical equipment, engines, auxiliary power units, tooling, aircraft hangars or ramp space, environmental contamination, or any similar claims, expenses, damages, or losses. 

 

SELLERS MAKE NO WARRANTIES OR REPRESENTATIONS WHATSOEVER CONCERNING THE PROGRAM SOLD HEREUNDER. YOU HEREBY EXPRESSLY WAIVE ANY CLAIM FOR INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY ECONOMIC LOSS, LOSS OF USE, LOSS OF REVENUE OR PROFIT OR DIMINUTION IN VALUE, AGAINST SELLERS OR SELLERS’S REPRESENTATIVES. 

 

This Hold Harmless Agreement is SPECIFICALLY INTENDED TO INCLUDE, BUT NOT BE LIMITED TO, THE HOLD HARMLESS OF SELLER, AND THEIR HEIRS, SUCCESSORS, ASSIGNS, INSURERS AND REPRESENTATIVES, FOR THE NEGLIGENCE OF THE SELLER AND THEIR AGENTS.  THIS HOLD HARMLESS PROVISION SHALL BE EFFECTIVE IN ALL RESPECTS, FOR THE NEGLIGENCE OF SELLER PRIOR TO THIS AGREEMENT AND FOR THE NEGLIGENCE OF SELLERS THAT OCCURS AFTER YOUR PURCHASE OF THE PROGRAM.  

 

By purchasing the Program, you agree and acknowledge that you are aware of the risks associated with cleaning and detailing aircraft, and you acknowledge that you have been provided an opportunity to review this Hold Harmless Agreement and consult with an independent attorney.
